Менський опорний заклад загальної середньої освіти І-ІІІ ступенів ім. Т.Г. Шевченка Менської міської ради (Чернігівська область) 1 травня за результатами тендеру замовив ТОВ «Будівельно-виробнича фірма «Кратос Плюс» будівництво протирадіаційного укриття за 107,70 млн грн. Про це повідомляється в системі «Прозорро».
До кінця року повинні побудувати шкільне укриття на вулиці Чернігівський шлях, 11 для 500 осіб. Закупівлю проводили згідно з інструментом Ukraine Facility.
У технічній специфікації тендерної документації замовник вимагав від учасників надати довідку довільної форми про відвідування та огляд об’єкта. Антимонопольний комітет неодноразово визнавав подібні вимоги дискримінаційними та зобов’язував замовників прибирати їх із тендерної документації.
Документ мав містити дату, інформацію про огляд, ПІБ і посади представників замовника та учасника, а також підписи й печатки обох сторін.
Дешевшими конкурентами були ПП «Фірма «Номінал» (104,53 млн грн) та ТОВ «БТ «Солонь» (105,08 млн грн). Їх пропозиції відхилили, зокрема, через те, що вони у довідках про огляд не вказали посаду уповноваженої особи замовника, а саме директор Тамара Шепель.
Розміщення вимоги про надання довідки огляду об’єкту у технічній частині тендерної документації дозволяє замовнику не давати учаснику 24 години на виправлення помилки. Отже замовник може відразу відхиляти пропозицію учасника, яка не відповідає умовам технічної специфікації.
Крім того відхилені учасники надали неповне підтвердження локалізації частини кабельної продукції, та «БТ «Солонь» замість динамічної визначила тверду договірну ціну.
Держаудитслужба провела моніторинг закупівлі і виявила порушення. Аудитори встановили, що у кошторисі укриття були закладені матеріали та обладнання походженням із неприйнятних країн для правил Євросоюзу. Йдеться, зокрема, про матеріальні ресурси з Туреччини, Великої Британії, Швейцарії, США, Таїланду, Японії та Канади.
Серед них:
- коробка зовнішнього встановлення Flamebox 100P E30 – Туреччина;
- кульовий кран Ayvaz – Туреччина;
- сифон HC7-FUNELL – Велика Британія;
- дизельний генератор Malcomson – Велика Британія;
- засувка Butterfly – Швейцарія;

- комутатор Cisco – Таїланд;
- радіостанція Kenwood – Японія;
- GSM-роутер Flyscale – Велика Британія;
- установка знезараження води VIQUA – Канада.
В межах програми Ukraine Facility діють спеціальні вимоги щодо походження товарів. За інформацією, розміщеною на сайті Міністерства економіки України, перелічені країни не входять до затвердженого переліку прийнятних країн відповідно до Європейського Парламенту і Ради (ЄС) та Рамкової угоди.
У результаті Держаудитслужба зобов’язала замовника привести договір у відповідність до вимог законодавства, а якщо це неможливо, то припинити зобов’язання за контрактом.

A school shelter worth 108 million was ordered in Mena with a blatant “loophole” regarding the site inspection
On May 1, following the results of a tender, the T.G. Shevchenko Secondary School (Grades I–III) of the Mena City Council (Chernihiv Oblast) commissioned the construction of a radiation shelter from the construction and production firm “Kratos Plus” for 107.70 million UAH. The document was required to include the date, details of the inspection, the full names and positions of representatives from both the customer and the bidder, as well as the signatures and seals of both parties.
The cheaper competitors were PP “Firma ‘Nominal’” (104.53 million UAH) and LLC “BT ‘Solon’” (105.08 million UAH). Their bids were rejected, in particular, because they did not specify the position of the client’s authorized representative—namely, Director Tamara Shepel—in their inspection reports.

Including a requirement for an inspection report in the technical section of the tender documentation allows the customer to avoid giving the bidder 24 hours to correct the error. Thus, the customer can immediately reject a bid that does not meet the technical specifications.
In addition, the rejected bidders provided incomplete confirmation of the localization of some cable products, and BT Solon specified a fixed contract price instead of a dynamic one.
The State Audit Service monitored the procurement and identified violations. Auditors determined that the shelter estimate included materials and equipment originating from countries not permitted under EU rules. Specifically, this refers to materials from Turkey, the United Kingdom, Switzerland, the United States, Thailand, Japan, and Canada.

The Ukraine Facility program imposes specific requirements regarding the origin of goods. According to information posted on the website of the Ministry of Economy of Ukraine, the listed countries are not included in the approved list of eligible countries as defined by the European Parliament and the Council (EU) and the Framework Agreement.
As a result, the State Audit Service ordered the contracting authority to bring the contract into compliance with legal requirements, and if this is not possible, to terminate the contractual obligations.
The T.G. Shevchenko Secondary School (Grades I–III) in Mensky is headed by Tamara Shepel, and the authorized procurement officer is Svitlana Bulavka.
Kratos Plus Construction and Production Firm LLC is registered in Chernihiv and is owned by Vadym Sendetskyi.
